The controversy over a politician-cleric’s marriage to an underage girl in Semarang.

43 year old Pujiono Cahyo Widayanto/Widianto, aka Syech/Syekh Puji, the head of an Islamic boarding school (Ponpes Miftahul Jannah) in Bedono, Jambu, Semarang, Central Java, in August 2008 informally married (nikah siri) Lutfiana Ulfa, 11 years and 10 months old, who had just begun studies at a local junior high school, but has now taken up wifely duties at home.

Sheikh Puji is a very wealthy man, being the owner of PT Sinar Lendoh Terang (Silenter), a handicrafts exporter, and appeared in the news in August for distributing 1.3 billion rupiah (about $130,000) in zakat or charity to the poor. His first wife is 26 years old. In 2005 he was a candidate for the Partai Amanat Nasional (PAN) in a regency election but withdrew from the race at the last moment, and has long been involved in local politics. suaramerdeka

He also intends to marry two other girls, aged 9 and 7. Of these latter two, Syech Puji says that neither has begun menstruating, so he will refrain from interfering with them, while Ulfa has already entered puberty.

Syech Puji believes his actions have a legitimate basis in Islam, considering that the prophet Muhammad married the 7 year old Aisha.

I’m not just doing what I like, it’s based in religion. It’s in accordance with the prophet’s teaching. You can marry a 7 year old if you like but you can’t have relations with her until she starts menstruating.

Clerics’ Council/Majelis Ulama Indonesia (MUI) leader Umar Shihab condemned the marriage to Ulfa:

Men should marry adults, there are a lot of other prospective brides around. Why has he married a 12 year old? The poor girl.

His actions have been mostly condemned in other quarters, with some saying that he has broken the Marriage Law, and is liable to criminal prosecution. lampungpost detik

One supporting voice is that of politician Hilman Rosyad Syihab from the Islamist Partai Keadilan Sejahtera (PKS), who says that marrying young girls is allowed within Islam provided the marriages are not consummated until the girl has begun menstruating. dutamasyarakat

    My wife’s aunt married her husband in 1970, he was 30 and the village school teacher in a kampung outside Bogor, she was his favourite pupil.

    She was 14.

    70s and beyond were kampungan years. It is norm for a peasant girl to be married off from age 14 to groom approved by their parents. As per Javanese tradition, the groom should not be older than the bribe’s parents.

    However, it is clear that this islamic pig is a child sex predator. He is 31 years different and could well be the same age as the poor child’s grandpa.

    My daughter is aged 6 and she like to jump into shopping trolley as I pushed it along the supermarket aisle. If you ever see a elderly bearded Arab men pushing trolley with a kid inside, chances are that little girl is his wife. This is Arab tradition and real islam which has no place in Indonesia.

    As AAB said, in the past, those kinds of practices were a bit on the normal side in kampungs. But this is 2008, and this kind of practice should be abolished.
    Also, during Soeharto, this happened but never once did a member of the DPR (at least I dont think so) publicly say it’s ok to do so.

    What the guy does is definitely repulsive, but what’s more disturbing is if the law enforcement doesn’t do anything to him. Lots of noises about his violating this and that law, but we have yet to see a real action.

    If the parents of the poor child gave permission for the marriage, they should too be held responsible for that; at 13 the girl is legally still under their custody.

    Funny how people think hiding behind religion can shield them from everything. It is even more ridiculous to see how people confuse religion with the law.

    I don’t care if the girl likes it, or if the parents allow it to happen. I hope justice is served.

    This story is really all over the news now, …..it seems he had a selection committee (Tim Sukses) to find more wives, there were 21 candidates and they narrowed it down to three, (he said there was a “fit and proper test”) Ulfa, who he married on 8th August, and the nine year old and seven year old, negotiations (presumably with the parents) are ongoing with those two.

    At his marriage on 8th August there were hundreds of people present, head of the village, two clerics who presided, lots of people from his company. He says he’s not insane because he’s built up a successful, big company, and that his first wife encouraged him to find more wives because she didn’t want to take care of the business (?). detik

    It is disgusting and appalling but what part of the world are we talking about. And why are we all shocked then. This is typical Indonesian Islamic practice as the story says above. I’ve seen it many times and it is with the consent of the parents 100% of the time. Replace that pious Indonesian with a bule and the mob would hang him by his nuts. Another example of bias and racism by the locals. In a bule country the law is the law and all are treated accordingly regardless of race colour and creed. But that is in the west where racial tolerance and the rule of law wins the day.

    In Holland in 1990 the age of sexual consent was lowered to 12. This was because so many young girls and boys of that age were being prosecuted for breaking the law and the elders were fed up with their taxes being used to prosecute for an offense that was co-sensual. (Both had agreed to have sexual contact.)

    So, they passed a law lowering the age of sexual consent to 12 with a proviso that any child who complained of being bribed, seduced or coerced could bring a charge of statutory rape though their parents. This also included anyone who was in a position of authority over the child, in that case it was an automatic prosecution by the State.

    Before 1990 the age of sexual consent was 14. All the evidence for when sexual interest is starting to the point where the child seeks out some form of sexual contact is the age of 12. Boys starts at 14.

    I talked to the chairman of Komnas Anak (national commission for children) and he said that this guy could be charged for 3 reasons: A. violating the marriage law (youngest girls are to marry at the age of 16, boys 19), B. violating the manpower regulation, employing underage children (by making her the general manager of his company), C. violating the child custody regulation (not sure if I’m using the right term) because 12 year-old child does not have his/her own consent to take a decision to get married. So it was clearly a “business trade”. The question is who is to bring him to court with these charges?

    The provincial government of Central Java had a discussion about this recently. And they sort of refused to handle this matter and “suggest” the NGO’s to do that instead.

    The NGO’s have difficulties in meeting the “unique” guy, so the case gets nowhere.

    So far.

    No not at all. Generally from poorer kampung communities. One was my maid who married at age 14. I mentioned this previously in another post. I used to mingle with the kampung nearby also as a way of meeting ‘real Indonesians’ not the middle class phonies you see in malls. Many were married to older men as a way of getting out of abject poverty. It is very wrong but in a society like that who could blame them or their parents. It is the guy who marries her who is at fault.

    @ Igun – How do you justify dragging the problems of the “West” into, at least in my mind, is a purely Indonesian made dilemna? This is not Michael Jackson or some other lesser known pervert from a country like say the Netherlands (as an example) sneaking around to prey on children. Those guys know its wrong, and against the law and do their disgusting actions in a stealthy way to avoid detection.

    However,this Sheikh Puji character is marrying these very young girls quite openly and in front of your whole nation and with the approval of at least some adults who are religious leaders in the community. He is even using the example of your prophet Mohamed and text from the Koran as justification for his actions. We should also consider that apparently, at least some Indonesian laws have been violated but who will enforce them? If not, why not? These are the questions that really need to be answered.
