Currently, Title 8 of the U.S. Code fills in those gaps. Section 1401 defines the following as people who are “citizens of the United States at birth:”

Anyone born inside the United States *
Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person’s status as a citizen of the tribe
Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

Wow you are really fishing. First it was that the UK claimed him, then it was that his “grandmother” claimed she witnessed his birth in Kenya, despite the existence of documents proving he was born in Hawaii.

Unfortunately, Obama’s State of Hawaii issued birth certificate is considered legal tender, whereas far-right, racist conspiracy blogs are not. This was deemed enough for the Supreme Court to boot the conspiracist suit, and since that majority conservative court is the highest authority in the land, it looks like it’s back to fantasy-land for the conspiracists!

Might also be illustrative to ponder the fact that this country elected a moderately liberal, half-black and well-spoken man because a majority of the electorate didn;t like the direction the country was headed in and wanted a change.

If they feel similarly in 2012 or 2016, so be it. That’s democracy.

So, since this is an Indonesia focused blog, do you have any comment on the recent Indonesian elections?

This is not a far right conspiracy theory. The Supreme Court gave the early cases the ‘boot’ due to standing…saying that the plaintiff did not have the right to bring the suit…NOT that the evidence is not true. Actually they never saw any evidence.

There is now two dozen lawsuits ranging from State and Federal courts right up to the Supreme court again. Obama’s lawyers have already been paid over $900,000.00 to keep his original BC under wraps (with more campaign $$$ going to them every week). This is the very BC that the Hawaiian governor said that she ’saw’. Why pay so much to keep anyone else from seeing it??? Especially since, over the past 12 years, all of Gore’s, Kerry’s, and Bush’s records were read with such scrutiny. Why does this guy get a pass? Keep the BC hidden, no passport files, no college records or thesis papers? What’s he tryin’ to hide?

There are also three state citizen’s grand juries who have just issued indictments on Soetoro/Obama for fraud. They are presently being presented to the authorities.

Sadly, many of you do not know the actual requirements. Obama’s mother was not old enough to have been a citizen long enough — it’s part of the way the requirements were written. Now, you can spin this any way you want, but that is the truth.

Just why is it that Obama has not only refused to allow ANY of his records be made public (this even includes his records when he was in the state congress!) but has gone to unimaginable lengths to keep these records from being made public, unless he has something to hide? Why did he have a FAKE birth certificate on one of his websites during the campaign and then pull it down after it was uncovered as a fraud? He wrote in a book about having his birth certificate with his books and just how much that birth certificate meant to him, YET, he now REFUSES to produce that birth certificate that was so sacred to him. WHY?

Why are Democrats who voted for Obama now anonymously saying that he is the greatest danger to our country now? They are claiming he will strong-arm until he gets what he wants, no matter what the cost. He has a history of this, just do your own research and you’ll find this true.

Barack Obama is not an american. I don’t think that Ann is his real mother.
She did not marry his real father until 1967, he was born in 1961. take a close look at the picture he is his father’s son, they look just like each other in the picture. Ann is his stepmother.

That is why his real birth certificate is sealed.

Why in the world did no one make more of an issue about Barry Soetoro Hussein’s citizenship? The people in power in the U.S. are lax and not doing their job, or was it by design? Obama is a liar, cheat and has ties to groups that are trying to take this country down. We better keep an eye on him. They should have an enity that watches him solely. The man is cunning ane has charisma like most crooks. His ties with Acorn which is supported by the New Black Panther Party and Bank of America has caused me to stop banking at B of A. I will be heading a demonstration at the Bank of America soon. I had written a letter, is fact it became three letters to Ken Lewis former CEO of B of A, he was fired. I questioned him about the banks contribution to Acorn, of course the answer came across as very vague. Anyway, Obama is not my president and I, in my 64 years have never been so disappointed in our country for electing a man whose citizenship was never proved without a doubt. In my opinion, it was all a put up deal and we will all pay and our children and grandchildren will too. It doesn’t matter if you are Democrat or Repbulican or independant, we all lost when Barry was elected. You’re right, I don’t respect him at all. He stands for bad, not good. Lin, you misread the article. the photo in the article is of Obama’s mom and his step-dad. She married Obama’s stepfather, Soetorro in 1967. Obama’s real father supposedly was Barack Obama SR. I agree he resembles his stepdad in the photo but that is not his father.

I think where he was born is not the issue. What he did was renounce his US citizenry when he returned to Indonesia as a young man. He reclaimed his citizenry there and traveled as a Muslim to Pakistan. He could NOT have visited there as an American and could not retain both legally. When he returned to the US it was as a citizen of Indonesia. This was overlooked because he never formally renounced his citizenry HERE but legally he was no longer a Native of the USA.
Everyone else is focusing on where he was born but there is a loophole in the requirements that state a child of a US citizen is a considered natural born citizen regardless of where they are born PROVIDED that they return to the US by their 23rd birthday.
He did that..but then he left on his own accord. That automatically cost him his natural born status and made him simply a naturalized citizen which as you should know by now..violates the requirement of POTUS

Agree there’s a segment of the Amer. population motivated by racial hatred, but there’s another group who believe no one including a president is above the law of the land. In U.S. law there’s something called ‘probable cause’ and its defined as: ‘A reasonable belief that a person has committed a crime.’ The circumstances surrounding Pres. Obama’s eligibility to hold the Office of President are construed by a great many Americans to be probable cause that a crime has been committed. As such it may deserve to be investigated further, and its unfair to suppose everybody wanting the truth has a racist agenda.

Odinius, Why won’t Soetoro/Obama release those birth documents? Why has he spent so much money and time fighting to keep them in the vault in Hawaii? We have men and women that he’s putting in harms way and he owes it to them to prove beyond all doubt he is a legitimate commander in chief. Why has he and does he continue to resist any scrutiny? What happened to transparency and integrity?

Further to Wonder Woman…. The 14th Amendment is also important if Barry Sr. was in Hawaii on scholarship and sponsored by the British colonial government. The 14th Amendment was set up to provide the unambiguous constitutional legal expression / basis for the citizenship clause of the Civil Rights Act of 1866. It excludes persons under the jurisdiction of another jurisdiction, specifically meaning children of foreign diplomats to prevent penetration of our government by foreign influence, and tribal Indians. Among other things, this means that Barry’s dad, Barry Sr. was selected by the Kenyan government and sent to America to attend university and therefore was likely on a diplomatic visa, therefore Barry was born the son of a diplomat on US soil which also disallows the privilege of a U.S. birth citizenship. If Barry Sr. was not on a diplomatic visa, it may be interpreted as such – so what do the records say? No one can say because all of Obama’s records are sequestered and unavailable.

Before crying to hang the guy out to dry for his unfortunate confusion about US citizenship status, consider who would automatically replace him for the remainder of his term–the VP. And, Lord forbid, if the VP could not fulfill that then the speaker of the House would become President. Do you really want either of them in his place?

Past history shows that when a charismatic person is cut down in his prime of public popularity (whether he is a rock star or President), the people turn him into a martyr. If he were allowed to live out his position, time eventually reveals his motives and whether or not he is deserving of that. Meanwhile, the real problem at hand is how to survive the wait and undo as much of the damage as possible afterwards.

But is it no wonder in Obama’s case that he displays little knowledge or interest in America’s lifestyle? How can he represent the people when he did not grow up exposed to the education and daily experience of the USA?

Be very careful what you wish for. The unintended consequences of proving Mr. Obama to be ineligible for the office of the presidency will range far beyond the imaginable.

It isn’t just a matter of a Joe Biden or Nancy Pelosi assuming the office and being less than qualified to serve but, rather, the illegitimacy of each and every official act undertaken during Obama’s tenure in office that must be considered.

I was one of the many small voices, crying in the wilderness during the campaign that his credentials should be thoroughly vetted. In point of fact, running for high political office in the United States requires less proof of eligibility than does obtaining a driver’s license.

The toothpaste, however, is out of the tube. Mr. Obama is the POTUS. As loathe as I am to say it, I feel we should let the matter lie and work to pass currently proposed legislation to require all future candidates, for election or re-election, to prove their eligibility. If Mr. Obama cannot produce proof of eligibility in 2012, he will simply go away and we can then set about undoing any harm his term in office has produced.

Proving his ineligibility after the fact of his assuming office has the potential to bring our entire government to a halt.

I greatly respect the Constitution of the United States, keep a copy next to my keypad at all times, and refer to it often. But this situation goes far beyond any scenario envisioned by the framers and it causes me to believe that it might be better to let this one slip through so long as we bar the door against any future usurpers.

God help the USA.

If his father was a citizen of the united kigdom and colonies and then Obama would also be a citizen under his father;s right as citizen. His father was never a natural born citizen. If his parents were married On February 2. 1961 and Obama was born later that year in August It woulld be she carried him for 6 months? And If They moved to Indonesia two years later he would be 3 not 2. Also if he was regesisted a s a foreind occudental student he would not have been american…..right?
