Laws that discriminate against women.

The recent 39th meeting of the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) in New York recommended Indonesia revoke all laws that are viewed as biased against women, said the Minister for Women’s Empowerment, Meutia Hatta, on 26th September.

Although Indonesia ratified the Convention 23 years ago Meutia says:

There are currently 29 laws which are gender-biased and we have suggested the relevant ministries amend them. I have heard that they are still evaluating them.

She cited the 1974 marriage law, which contains articles that permit men to commit polygamy, but not women, in the case of a wife’s infertility or inability to perform her “wifely duties”, and which also allows girls of 16 and 17 to marry, even though in other statutes such girls are considered still to be children.

Meutia said the Women’s Empowerment ministry had asked the Religious Affairs ministry to review any discriminative laws within its authority but had not yet received a response.

She went on to say that at the meeting in New York concerns were also raised about the effect of the regional autonomy policy which had created discriminative regulations against women, such as the 2005 by-law in Tangerang, Banten, which stipulates that any woman seen alone in public after 19.00 could be considered a prostitute and arrested, as well as the various regional laws, such as this one in Malang, requiring women to obtain permission from their husbands to work at night.

Meuthia said the meeting also criticized the Indonesian government for its failure to fully integrate CEDAW convention compliance into Indonesian laws. The minister said this was because the details of the CEDAW convention were not yet known by government bodies.

CEDAW also asked the government to issue a firm policy against female circumcision.

Indonesia had not received an all negative report card however:

They noted some improvements like the issuance of the 1999 Law on Human Rights, the amendment to the 1945 Constitution, the 2004 Law on the Elimination of Domestic Violence, the 2006 Law on Witness’s and Victim’s Protection and the 2007 Law on Human Trafficking.

They guard their unseen parts because Allah has guarded them. As for those from whom you fear disobedience, admonish them and send them to beds apart and beat them. Then if they obey you, take no further action against them. Surely Allah is high, supreme.

    If you fear a breach between a man and his wife, appoint an arbiter from his people and another from hers. If they wish to reconciled, Allah will bring them together again. Surely Allah is all-knowing and wise. (Quran 4:34-35)

    Child, who is your father? If a woman can commit to polygamy, that the first question ask from child’s mother. Because in millions seed, only one can reach “the goal”.

    There is still polyandrical family form in the western Himalaya and some other places in this world and – as far as I know – the mothers don’t ask such stupid questions because in such community are other things important. Such questions come usually out of male brains having the delusion that they are the rulers and the protectors.
    And the children? They first call:” Mammaaaa!”. 🙂

    Your post is a reason why I have an difficulty to explaining about that “controversial” verse (for human). But, I belief Allah does not no intention transform that verse. However, I try to, firstly, describing differences between western and eastern culture through song, poems, rhymes, and imaginary conversations (maurice, maureen, moron).

    Quran, whom I believe from Allah, have verses that many woman (modern) arguing at -as you do. Including verses which allows man can have four women (I will post it). Many man also woman mostly still do not understand what a kind verses is. To pleasure man, and discriminating woman or what.

    Frankly speaking, until now, I still find a proper best way to describe it to many woman. My belly dancer has already understanding. It is difficult to (modern) woman especially who have higher earning or position to believe it. But, its exist in Quran. Should I smarter than Allah to deny that verse? Whoops.

    But, when my father married another woman, after my mother, along time ago, (it is not an adultery reason) I hardly to find a way to explain it to my mother. Its was not defending as man to man.     Yes, I agree to you. And, why as a nation, on any matter, we look outward first (like Meutia Hatta did). Then other culture could easy impose Indonesians. Not only Arabians, you can hear many words in bahasa Indonesia from alien cultures. Not only English (in modern Indonesia era), as a lingua franca, Bahasa Melayu where Bahasa Indonesia came from, had had many alien’s culture influence.

    Be they men or women, the hypocrites are all alike. They enjoin what is evil, forbid what just, and tighten their their fists. They forgot Allah, so Allah forgot them. Surely hypocrites are evil-doers.

    Allah has promised the hypocrites, both men and women, and the unbelievers, the fire of Hell. They shall abide in it for ever; a sufficient recompense. The curse of Allah is upon them; lasting awaits them. (Quran 9:64-68)

    I do not see any relation from Republic of Indonesia to impose exclusive rule (in this case Islam) to public matters or nation wide affairs. How come? Polygamy is an individual matter (for moslem) not public matter issue. It is scared thing. For moslem, it is individual’s choice. No man or woman enforcing to do polygamy.

    And, I do not see any connection between legalize polygamy and, as Raden Says: In Indonesia today, The winner is: Islam radicalism ideology with agenda of Arabisation, swap your blangkon & batik kebaya with your beard, tudung & Arab’s sorban.

    What is radicalism ideology mean? What is Arabisation mean? It is mean that all Indonesian has to wear what Arabian wear? Or what? It is mean all Indonesian must have weird or what? What is radicals Islam? I did not get any clear picture on this post. Please elaborate. Someone who marry to four women is radicals. Arabisation is omeone who marry to four women is radicals?

    What is Arabisation? I mean by definition or terminology, please clear my picture, what do you mean Arabisation? What is radicals Islam? I do not see any connection between a (group of) people that marry more than one wife is radicals or being Arab. They are whom enjoying their life (a man who having healthy sex life with four wives), then you says radicals or Arabisation. Whassup.

    I think discussion about Discrimination on Woman is important because it is sacred. This issue related to woman – mother, kaum ibu – Sylvester Says: Many indonesian agree that “surga di bawah telapak kaki ibu” to whom the Lord brings all human races to this world including your momma and my mother.

    However, we can discuss this matter as mature-unprejudice-openminders persons. This is not infant talking. So, we are not wasting our time just to bladah-bladah-bladah. And, most important is we can learn how to bridge any differences between us. As a nation, Indonesians need to learn how life in diversity after 31 years living under pressure. Don’t forget to our country’s foundation, Bhinneka Tunggal Ika. Living in Diversity.

    Do people actually read them? Let people decide it.

    Janma Says: Actually Muhammad (God bless him) didn’t really support polygamy, he quite clearly says that there are strict conditions to adhere to in the case of polygamy and also says those conditions are almost impossible to fullfil, that is hardly a green light for polygamy!

    Better I quote this first:

    These shall be no compulsion in religion. True guidance is now distinct from error. He that renounces idol-worship and puts his faith in Allah shall grasp a firm handle that will never break. Allah hears all and knows all. (Quran 2:256)

    Surely. Not only for woman, for a man too. However, in this life, as Allah’s creature, do we always put something on our personal best interest only? How about other people interest? How about Allah interest? Don’t be forget, we live for pray and worship Allah. Polygamy, as I said, believe for man both woman to receipt that terminology. But, there is still does not any compulsory here. As a human being, we have self determination to do or not to do, to obey or not to obey, include polygamy.

    As personal, indeed, The Prophet Muhammad was not intend to commit polygamy. But, It is instruction from Allah (I do not know what the reason). The Basic Question is what you true believer or not? If and only if you (women) are true believer could accept that reality.

    And, for them whose intend to insult Allah and the Prophet Muhammad, for this matter, better read it:

    Those who speak ill of Allah and Allah’s apostle shall be cursed by Allah in this life and in this life to come. He has prepared for them a shameful punishment.
    Those who traduce believing men and believing women undeservedly shall bear the guilt of slander and grievous sin.(Quran 35:57-58)

    If the hypocrites and those who have tainted hearts and the scandal mongers (of Madinah) do not desist, We will rouse you against them, and their days in that city will be numbered. Cursed wherever they are found, they will be seized and put to death.(Quran 35:60:-61)

    I think so, a hypocrite who hide behind Quran to legalize his square ideology. Ade Wanto, I suggest you ask PM Badawi who are facing many legal implication dualism when there are intermarriages between muslim and non muslim, when a non muslim wife of a muslim husband died, when a muslim Malaysian silently marry with Vietnamese buddhist in other country and one day the child’s mother insist to live in Malaysia for a better education in Terengganu, etc etc ….
    Malaysia is facing 2 law, local syairah law which is a compulsory abide by all muslim and civil law … and u said it is not a problem to the rest of non muslim with zero implication ??

    Are you a Muslim, Parvita? If polygamy is allowed in the Qur’an and you’re questioning whether a polygamous marriage institution is acceptable and understandable by our standard, then aren’t you in fact questioning the Qur’an itself?

    Only some of them are using the Quran to justify their desire.

    Remember, Abraham had two wives. If we analyse further, many people in the Old Testament are polygamist. However, it does not mean Judaism and Christianity allow polygamy. Christianity and Judaism is strictly monogamist and respect women.
